We offer extensive support, usually through internet and phone calls, via our experienced multicultural team.

In general, properties that we work with should offer, usually through their staff, cleaning and check-in/out service. Hence, please specify in the correspondent field above any costs you might have to offer these services, so they can be paid.

1. I grant, continuous and free of charge, wide media utilization rights relative to the property, between photos and videos, to be promoted via internet and by traditional marketing, as long as the main purpose is guaranteed. I confirm to have rights myself to the media that I will provide.

3. Work Model

 

I understand the responsibility of accepting a booking and will always honor my business commitments. In the impossibility to host a confirmed booking (excluding legally accepted reasons), I will be responsible for eventual costs in the reaccommodation of the clients or from the booking cancellation. 

4. Payment Dates

All payments are guaranteed. When a booking is confirmed through a Partner, we have their commitment of payment on the agreed date, and they never fail. In addition, if a partner would ever fail payment, LW would honor payment in their name.

We will do Marketing distribution according to your answers. More strict preferences regarding Work Model, Payment Dates and Cancellation Policy will reduce marketing reach and bring less requests and bookings. In the other hand, accepting Instant Bookings or greater payment and cancellation flexibility will generate much bigger visibility and demand, resulting in (much) more business.

We wish to reiterate that all payments are guaranteed. Payment date is a matter of flexibility, but never risk. If a booking was confirmed through a Partner and they ever fail to pay, something that never happened and most probably never will, we would guarantee the payment from our side.

 

BROKERAGE AGREEMENT 

PARTIES

Luxury Worldwide LLC, a real estate management company headquartered at 530-B Harkle Road, STE 100, Santa Fe, New Mexico, Zip Code 87505, hereinafter referred to as “LUXURY WORLDWIDE” or “LW”.

And the author of the completion of the current Brokerage Form and Contract, personally identified in your responses above, hereinafter referred to as “OWNER”.

The "official means of contact" when mentioned throughout the Agreement refers to email addresses to be used exclusively to send formal written notices regarding this Agreement. These are owners@luxuryww.com for LW and the email address used to fill this document by the OWNER.

Each PARTY is responsible for communicating to the other PARTY any changes to their contact information.

The OWNER hereby certifies to be the Legal Owner of the PROPERTY described in the Form, having its legitimate and continuous possession, and ensures that it is free from any liens, debts or lawsuits that could affect its possession, in addition to having the authorization from the Condo or City in which the property is located in to carry out the activities proposed here.

 

 The PARTIES agree to be bound by this Brokerage Agreement, according to the following clauses and conditions:

OBJECT

LW will provide the OWNER with real estate intermediation service through promotion and marketing in the contracted form, namely seasonal rents (up to 90 nights) mainly, and Sale of the PROPERTY, if this field has been completed on the Form.

 

REMUNERATION

LW is entitled to remuneration for its services, which takes place in the form of markup (a fee added over net values informed by the OWNER on the Form). The efforts and investments undertaken to find clients are made entirely by LW, and therefore any future reservations in which this client may participate shall entitle remuneration to LW, in the form of commission.

LW respects commission percentage levels suggested or stipulated by local professional class councils. In the event of any commission due, the appropriate Schedule of fees from the official professional class council (CRECI, in Brazil) will be used to determine commission rate, where the higher accepted legal percentage shall be considered.

The OWNER has stipulated the expected and desired net amounts for each season and periods in his responses to the Form and therefore sees them as fair and adjusted. Hence, the OWNER cannot demand a different value for businesses made under these conditions.

Further adjustment of prices ​​is possible and accepted, and only requires it to be informed through the official contact method, and becomes effective from the moment of confirmation of receipt and response by LW, or within 2 days, whichever comes first.

 

PAYMENT METHOD

Payments to OWNER will either happen in accordance with LW's standard payment term rules, which means 50% of the total amount at the time of booking and Balance up to 10 days prior to entry, either following the affiliate partner payment term rules, respecting the Payment Term preferences indicated by the OWNER in his response to the Form, or when LW obtains approval from OWNER to work with a different payment term rule, always granting up to 3 working days from the time the amounts are released to LW to do the bank transaction, when applicable.

If the OWNER receives the surplus, characterized as LW Remuneration, he will also have the same 3 working days to do the commission's payment bank transaction.

 

TERM

This contract has an indefinite term, and may be terminated at any time by both PARTIES, as long as there is formal written notification through the official means of contact, and will be taken into account at the time of confirmation of receipt or in 5 business days of delivery, whatever happens first.

Termination will not affect future or pending commissions, which must be received or paid in full. The same is true for deals being confirmed after the termination of this instrument, but due to client intermediation services carried out by LW, either directly by the OWNER or through third parties, as long as the client has been introduced by LW.

 

AUTHORISATIONS

The OWNER declares for all applicable purposes to accept the conditions and other Clauses set out herein, in addition to ratifying the authorizations and preferences indicated in the Form above, expressly authorising LUXURY WORLDWIDE to market the said PROPERTY in the agreed terms, knowing that he may request further changes and revisions, whenever he deems necessary.

Along with Luxury Worldwide LLC, the OWNER also authorizes the company Luxury Worldwide Brasil LTDA, a real estate management company headquartered at São Paulo, São Paulo, Brazil, holding a local Company ID # (CNPJ): 24.867.369/0001-64, registered at the Regional Board of Realtors (CRECI) with # 42205-J,  in the same terms of this document.

Expressly AUTHORIZES LW to receive amounts which will then be passed on to you following the agreed Payment Terms and Cancellation Policies. Also to represent you in the Lease Agreements accepted by you through the authorization in the Instant Booking Work Model or from your prior written authorization in the On Request modality, and LW may eventually deliver and receive keys, intermediate maintenance services, sign inspection reports, authorization of visits and events, among other activities inherent to the business being carried out, in line with the interests of the OWNER, considering everything as good, correct and satisfactory.

The responsibility to inform change in availability, either manually or through ICAL online shared calendar, or property characteristics is exclusive and restricted to the OWNER, and should be made solely through the official means of contact.

LW will perform its services always taking into account the latest information provided regarding the PROPERTY and the OWNER's preferences.

 

RESPONSIBILITY

The OWNER has full autonomy of decision regarding his property and can block all dates and refuse to accept all requests. However, from the moment he accepts a booking, either through “Instant Booking” authorization or through written confirmation on “On Demand” requests, he must always honor the commitments made, or in the impossibility of doing so (excluding possible legal permissions), take responsibility for any liens on relocating the guest or cancelling the booking.

 

CONTRACTUAL BREACHES

Paragraph 1 - In the absence of spontaneous payment of the amounts to which the PARTY is entitled, the other PARTY may make use of the appropriate legal means available to them, whether extrajudicial or judicial, with the proven debtor party being responsible for all necessary costs for this purpose, including attorney fees.

Paragraph 2 - Any tolerance with any obligation provided for in this instrument, will not result in novation, maintaining all its clauses intact.

Paragraph 3 - If any court or authority declares, for any reason, null, invalid or unenforceable any clause, part of a clause or clauses, the remaining clauses and/or parts of clauses of this instrument will remain in force, and the Parties must negotiate the replacement of that contractual provision by another or others that restore the initial balance.

Paragraph 4 The Parties elect the Court District chosen by the OWNER just below, as long as it is a city in Brazil, to resolve any doubts arising from this instrument, waiving any other, however privileged it may be.
